1. Subject and Binding Order

Using the eGommerce.it website constitutes an express acceptance of these terms and conditions by the visitor. If you do not agree with the conditions established here, it is recommended not to use this website. HARDGREEN S.R.L. reserves the right to modify or update these terms and conditions at any time. Once you have completed and submitted the order and payment for the selected items, the order will be binding. By placing the order, you declare that you accept the general conditions and wish to purchase the chosen items. We will send you a confirmation email for the order.

2. Right of Withdrawal

Every product for sale is covered by the right of withdrawal warranty, as provided by Legislative Decree 15 January 1992, No. 50. The right of withdrawal must be exercised within 10 days from the delivery of the product through written communication (registered letter with return receipt). The registered letter with return receipt must contain the intention to exercise the right of withdrawal, the indication of the product, the subject of the dispute, the description of the related order, and the invoice number. The return can only be accepted if the product is intact. If the goods have already been delivered, to exercise the right of withdrawal, the consumer must return the goods in accordance with the methods and deadlines provided in the contract (which cannot be less than ten working days from the date of receipt of the goods). Furthermore, the return of the goods will not be accepted if they show signs of wear, and thus the right of withdrawal will expire when the “essential condition of integrity of the goods” is not met. In the event of the expiration of this right, the company will return the purchased goods to the sender, with the shipping costs charged to the sender. The products will be collected by Hardgreen S.R.L. with the collection costs charged. The refund will be made within a maximum of 30 days from the receipt of the withdrawal notice, and in any case, upon receipt of the goods at our warehouses. After mounting the tires or snow chains on your vehicle, the right of withdrawal cannot be exercised anymore. It is only valid if the purchased products have not been used or mounted. In the case of delivery to a workshop, the customer must ensure before the installation whether the tires are suitable for the ones ordered. The customer cannot hold Hardgreen S.R.L. or the tire fitter responsible after the tires have been installed.

3. Personal Data

In accordance with Article 13 of Law No. 196/03:

The data we collect is solely for the purpose of providing the requested services and is stored in our computer system. The customer has the possibility to modify and/or request the deletion of the data at any time.

The data will not be transferred to anyone without prior authorization. They are accessible to the technical staff in order to ensure their proper maintenance.

At any time, the customer can request confirmation of the existence or non-existence of personal data concerning them, as well as information regarding the origin of the personal data, the purpose and methods of processing, and the logic applied in processing carried out with the aid of electronic tools.

4. Password Management

Hardgreen s.r.l. provides the opportunity to purchase eco-friendly products on this website. To access these services, it is necessary to enter a password and username. This password is strictly personal, and it is the responsibility of the customer to ensure its confidentiality. The visitor is responsible for the use of this password, and under no circumstances can Hardgreen s.r.l. be held liable for any loss or damage caused by the use of this password. The visitor is required to inform Hardgreen s.r.l. of any fraudulent use of their password.

5. Property Rights

The content (including data, information, illustrations, logos, trademarks, etc.) available on the website egommerce.it is protected by copyright and intellectual property rights and is the exclusive property of their respective owners. The layout of our website follows the company’s criteria. We cannot guarantee that our website meets all customer requirements and is accessible 24 hours a day, without interruptions, securely, and without errors. The use of the website is the responsibility of the customer. We do not assume any responsibility for any effects caused by the use of the website and for the accuracy of the information obtained from our website.

10. Prices

All prices listed on the website, in the corresponding column, are inclusive of VAT. Prices may be modified at any time without prior notice.

11. Product Availability

The availability of products is indicated in the product showcase published on the eGommerce.it website. Hardgreen.it does not guarantee the certainty of the allocation of ordered goods. If a requested product, available at the time of online purchase, is not actually available, the customer will be contacted, and if requested, a refund will be provided via bank transfer after requesting personal information for the banking transaction.

12. Warranties

All tires sold by us are covered by a regular warranty for a duration of 2 years from the date of purchase. The warranty will be directly provided by the tire manufacturers. Goods requiring warranty service must be shipped at your expense to our warehouses, where they will be examined by the technicians of the tire manufacturers to determine any factory defects, user negligence, and primarily to verify the mileage covered with them. The obligations of the warranty are established by Legislative Decree no. 24 of February 2, 2002. It is essential to provide the order number and invoice number as proof of tire purchase.

13. Deliveries

Tire delivery will be carried out by express courier. The average delivery times are 2 working days for Northern Italy, 3 working days for Central Italy, 5 working days for Southern Italy, and 7 working days for islands and remote areas. During peak demand periods, delivery times may increase by 2-3 days. Hardgreen S.r.l. does not guarantee delivery on the estimated date at the time of purchase, as it is purely indicative. Delivery is only available in the islands of Ustica, Pantelleria, and Lampedusa upon prior email request and with an additional transportation cost of €20 per delivery.

14. Buyer’s Obligations and Responsibilities

Once the “online” purchase procedure is completed, the consumer and/or customer undertakes and obliges to print and retain these general terms and conditions (which they have already viewed and accepted at the time of purchase) in order to fully satisfy the condition set forth in Articles 3 and 4 of Legislative Decree no. 185/1999. The buyer is strictly prohibited from entering false and/or imaginary data in the Online Order procedure required to activate the process for executing this contract and related further communications; the personal data and email address must exclusively belong to the buyer and not to third parties or imaginary entities.

15. Jurisdiction and Competent Court

Any dispute concerning the application, performance, interpretation, and violation of purchase contracts concluded “online” through the website is subject to Italian jurisdiction. These general terms and conditions are governed, to the extent not expressly provided therein, by the combined provisions of Legislative Decree no. 50 of January 15, 1992, and Legislative Decree no. 185 of May 22, 1999, where applicable. Any dispute between the parties regarding the application, performance, interpretation, and violation of this contract shall be subject to the exclusive jurisdiction of the Court of Milan.
